These Terms & Conditions govern all orders placed with Elite Apparel (“Elite Apparel”, “we”, “us”, “our”). By placing an order, paying a deposit, or approving artwork, you agree to be legally bound by these Terms.

By submitting an order, paying a deposit, approving artwork, or accepting a quotation, you:

• Confirm you have read and understood these Terms;
• Agree to be legally bound by them; and
• Acknowledge that custom orders are final and binding.

No variation of these Terms is binding unless agreed in writing by Elite Apparel.

• All quotations are valid for 14 days unless otherwise stated.
• Prices are subject to change due to supplier increases, freight adjustments, or currency fluctuations.
• Orders are not confirmed until payment (or approved deposit) is received.

Pricing Errors

Elite Apparel reserves the right to cancel or amend any order affected by:

• Website pricing errors;
• Technical malfunctions;
• Supplier pricing inaccuracies;
• Typographical mistakes.

If this occurs, you will be notified and offered the option to proceed at the correct price or receive a refund.

Product images are for illustrative purposes only. Colours may vary depending on screen display settings.

Production commences only after:

• Full payment or approved deposit; and
• Written artwork approval (where applicable).

Once production has commenced:

• Orders cannot be cancelled.
• Changes are not guaranteed.
• Amendments may incur additional fees.
• Deposits are strictly non-refundable.

All change requests must be submitted in writing. Elite Apparel is not responsible for customer errors in approved artwork, sizing, spelling, quantities, or order details.

All decorated, embroidered, printed, or custom garments are made-to-order.

NO REFUNDS OR EXCHANGES

Except where required under Australian Consumer Law (ACL), custom goods are strictly non-refundable and non-exchangeable.

We do not provide refunds or replacements for:

• Change of mind
• Incorrect sizing selected
• Failure to request artwork updates
• Customer-supplied artwork errors
• Minor colour variation between digital proofs and finished goods
• Minor placement variation within industry tolerances
• Low-resolution or unsuitable artwork supplied by the customer

By approving artwork or a mock-up, you accept full responsibility for the final production outcome.

All garments are subject to standard manufacturing tolerances.

• Size variance of ±1–2cm is industry standard.
• Colour variation between batches may occur.
• Placement variance within 1–2cm is acceptable.
• Slight stitching irregularities may occur.

These do not constitute defects.

Brand longevity depends on proper garment care.

Elite Apparel is not liable for:

• Fading, cracking, or peeling caused by incorrect washing;
• Damage caused by ironing over prints;
• Tumble drying contrary to care instructions;
• Chemical exposure or misuse.

Shrinkage due to failure to follow care instructions is not a defect.

Nothing in these Terms excludes rights under the Australian Consumer Law.

If goods have a major failure, you are entitled to:

• A refund or replacement; and
• Compensation for reasonably foreseeable loss.

If goods have a minor failure, Elite Apparel may choose to repair or replace within a reasonable time.

For clarity, the following are not major failures:

• Change of mind
• Incorrect sizing selection
• Courier delays
• Minor variations within manufacturing tolerances

Assessment of whether a failure is major or minor will be made in accordance with the Australian Consumer Law.

Goods are considered defective only where:

• There is a clear manufacturing fault; or
• Branding materially differs from approved artwork due to production error.

The following are not defects:

• Minor colour variation
• Placement tolerance within 1–2cm
• Natural fabric characteristics
• Wear and tear
• Damage caused by misuse
• Customer-supplied artwork quality issues

Claims must be made within 7 days of delivery with photographic evidence.

By submitting artwork, you warrant that:

• You own the intellectual property; or
• You are legally authorised to reproduce it.

You indemnify Elite Apparel against any claims arising from copyright or trademark infringement related to customer-supplied content.

We reserve the right to refuse artwork that may breach laws or third-party rights.

Repeat orders will be produced using the most recently approved artwork unless written changes are provided prior to order placement.

Failure to request updates releases Elite Apparel from responsibility for outdated branding.

Certain supplier restrictions may require garments to include Elite Apparel branding if no custom branding is requested.

Where applicable, this will be disclosed in product descriptions.

If a product becomes unavailable:

• You will be notified;
• Alternatives may be offered;
• You may wait or select a substitute.

Elite Apparel is not liable for supplier or manufacturer delays beyond our control.

Estimated dispatch times (from payment & approval):

• Unbranded garments: 3–7 business days
• Branded garments: 10–15 business days
• International direct items: Up to 20 business days

These are estimates only and not guaranteed delivery dates.

Elite Apparel is not liable for courier delays once dispatched.

Risk transfers upon dispatch or collection.

Partial shipments may occur where necessary.

Shipping is calculated at checkout.

International customers are responsible for:

• Duties
• Taxes
• Customs charges

Elite Apparel is not responsible for customs delays or seizures.

Orders must not be collected until written confirmation is provided.

Orders not collected within 14 days of notification may incur storage fees.

Initiating a chargeback for a valid custom order constitutes breach of contract.

Elite Apparel reserves the right to:

• Dispute chargebacks using artwork approvals and production records;
• Recover administrative and chargeback fees;
• Engage debt recovery services;
• Recover legal costs on an indemnity basis.

Approved custom orders are legally binding.

To the maximum extent permitted by law, Elite Apparel’s liability is limited to:

• Repair; or
• Replacement; or
• Refund (where required under ACL).

We are not liable for:

• Indirect or consequential loss;
• Loss of profits;
• Business interruption;
• Event cancellation due to delayed delivery;
• Reputational damage.

Total liability shall not exceed the amount paid for the goods.

Personal information is handled in accordance with our Privacy Policy.

By placing an order, you consent to collection and use of your information for order processing and related communications.

Elite Apparel is not liable for delay or failure due to events beyond reasonable control, including:

• Supplier shortages
• Freight disruption
• Natural disasters
• Machinery breakdown
• Industrial disputes
• Government restrictions

Timeframes will be extended accordingly.

We reserve the right to refuse service to customers engaging in abusive, threatening, or inappropriate conduct toward staff.

Elite Apparel may update these Terms at any time.

Orders are governed by the Terms in effect at the time the order is placed.

These Terms are governed by the laws of Victoria, Australia.

Disputes are subject to the exclusive jurisdiction of the courts of Victoria.

By placing an order with Elite Apparel, you confirm that:

• You have read and accepted these Terms;
• Custom orders are strictly no refund except as required by law;
• You accept responsibility for approved artwork, sizing, and order details.
