These Terms & Conditions (“Terms”) govern all orders placed with Elite Apparel (“we”, “us”, “our”). By placing an order, approving artwork, or making payment, you agree to be legally bound by these Terms.

By placing an order, you confirm that:

• You have read and accepted these Terms;
• You have authority to enter into this agreement;
• You understand that custom-made orders are final and binding, subject to your rights under the Australian Consumer Law.

Electronic acceptance (including checkout, email approval, or invoice payment) constitutes a legally binding agreement.

• Quotes are valid for 14 days unless otherwise stated.
• Prices may change due to supplier costs, freight, or currency fluctuations.
• Orders are not confirmed until payment or agreed deposit is received.

Pricing Errors
We reserve the right to cancel or amend orders affected by pricing or technical errors. You will be offered:

• A full refund; or
• The option to proceed at the corrected price.

We reserve the right to refuse or cancel any order prior to production where:

• Products are unavailable;
• There are pricing or description errors;
• Artwork raises legal or compliance concerns;
• Operational limitations apply.

Production will only commence once:

• Payment or deposit is received; and
• Written artwork approval is provided.

After production has commenced:

• Orders cannot be cancelled;
• Changes are not guaranteed;
• Additional costs may apply.

By approving artwork, you accept responsibility for:

• Spelling, layout, sizing, and design accuracy;
• Colour selection;
• Overall design outcome.

Important:

• Mock-ups are not to scale;
• Colours may vary between screens and physical products;
• Production methods may produce variation.

We will reproduce approved artwork with due care and skill, subject to reasonable industry tolerances.

You warrant that you own or have rights to use all artwork provided.

You indemnify us against any claims arising from:

• Copyright infringement;
• Trademark infringement;
• Unauthorised use of intellectual property.

We may refuse artwork that presents legal risk.

All custom garments are made-to-order.

Refunds or exchanges are not provided for:

• Change of mind;
• Incorrect size selection;
• Customer-supplied artwork issues;
• Minor variations;
• Failure to request changes before approval.

This is subject to your rights under the Australian Consumer Law.

The following are not defects:

• Size variance ±1–2cm;
• Placement variance ±1–2cm;
• Colour variation between batches;
• Minor stitching inconsistencies.

Variations may occur across bulk orders.

We are not responsible for damage caused by:

• Incorrect washing or drying;
• Ironing over prints;
• Chemical exposure;
• General wear and tear.

Goods are defective only where:

• There is a manufacturing fault; or
• The product materially differs from approved artwork.

Claims must be submitted within 7 days with:

• Order number;
• Description;
• Photo evidence.

Nothing excludes your rights under the Australian Consumer Law.

• Major failure → refund or replacement
• Minor failure → repair or replacement within reasonable time

Timeframes are estimates only and may vary due to operational or supplier factors.

• Shipping times are estimates only;
• Risk transfers upon dispatch;
• We are not liable for courier delays.

Customers are responsible for duties, taxes, and customs fees.

Ownership remains with Elite Apparel until full payment is received.

Deposits are non-refundable.

We reserve the right to dispute invalid chargebacks and recover associated costs where permitted by law.

To the extent permitted by law, liability is limited to:

• Repair;
• Replacement;
• Refund.

We are not liable for indirect or consequential loss.

We are not liable for delays caused by events beyond our control.

We may refuse service for abusive or inappropriate behaviour.

These Terms are governed by the laws of Victoria, Australia.

Elite Apparel may update these Terms at any time.

Orders are governed by the Terms in effect at the time the order is placed.
